But really, what if you weren't aware of the person's sexuallity? Would you have to prove that you didn't know or if you did know that it didn't matter in order to not be charged with both?

What you thought only goes to INTENT! In other words was it an accident, were you in "the heat of passion", were you threatened(self defense) or was it premeditated?

If I beat one person to death because I HATE his country music and beat another to death because he is gay, THEY BOTH ARE JUST AS DEAD!!!!
WHAT we are moving to (and the democrats are pushing for) is a time where crimes against certain political beliefs/classes are more serious than the same exact crime against other political beliefs i.e. killing a liberal is WORSE than killing a conservative or killing a man who likes other men is worse than killing a man who likes women. Of course THEY will be the arbiters of what classes/political beliefs are protected.
THUS you never see "hate crime" charges when for example four black men and a black woman kill and torture two white co-eds
(Knoxville, Tn February this year). Ironically in that case the Nashville media (Knoxville is 200 hundred miles away) REFUSED to cover it at all even after I and several others called them on it. They said it wasn't a local story. The EXACT SAME Nashville media (the Tennessean) just last week did cover a Knoxville story where a woman found her cat dead with a fire cracker stuck in it's mouth.
But given their drive-by media bias it isn't that surprising that the Tennessean thinks a dead cat is a more VALID news story than the TORTURE of two white college students. AND THESE ARE THE SAME PEOPLE PUSHING FOR MORE "HATE CRIME" LAWS!!!!!  |

I think the ONLY place I saw it was on crimelibrary.com. My God, what they did to those two young people was atrocious.  Never heard a peep from Jesse or Al on that one.
