So Rudy says illegal entry into the U.S. is not a federal crime and that he doesn't think it should be, either. Apparently some in the 2005 US congress were "confused" on this issue also:
As always Wilthrill is here to help:
OK polichickens listen up. The word ILLEGAL, by definition, means a crime has taken place. Furthermore, as you clucksters are always telling the states that do try to enforce the law, immigration law is FEDERAL therefore the resulting crime is, by definition, FEDERAL. Hell, even in the article they come right out and say illegal entry into the US is a misdemeanor. A misdemeanor is defined as a CRIME the penalty for which is a fine or jail time less than one year.
DO YOU REALIZE HOW STUPID IT SOUNDS TO SAY "iLLEGAL ENTRY IS NOT ILLEGAL"???
WE DO!!!
And just in case any think I'm busting Rudy's chops on semantics check out his record on illegal immigration.

from the article:
New York City's sanctuary policy was created in 1989 by Democrat Mayor Ed Koch and upheld by every mayor succeeding him. When Congress enacted immigration reform laws that forbade local governments from barring employees from cooperating with the INS, Giuliani filed suit against the feds in 1997. He was rebuffed by two lower courts, which ruled that the sanctuary order amounted to special treatment for illegal aliens and was nothing more than an unlawful effort to flaunt federal enforcement efforts against illegal aliens. In January 2000, the Supreme Court rejected his appeal, but Giuliani vowed to ignore the law.
